Purpose

These Terms of Use (ToU) define the terms and conditions for using the BerryParachutisme.fr website (hereinafter "the Site"), published by SAS Flyingmany under the Berry Parachutisme brand. Any access to and/or use of the Site implies full and unreserved acceptance of these ToU by the user.

Site access

The Site is freely accessible to any user with internet access. All costs necessary to access the Site (hardware, internet connection, etc.) are borne by the user. Berry Parachutisme reserves the right to modify, interrupt or suspend access to the Site at any time, particularly for maintenance purposes, without notice and without liability.

Site usage

The user agrees to use the Site lawfully and in accordance with these ToU. The following are strictly prohibited:

• Using the Site for unlawful, fraudulent or immoral purposes

Berry Parachutisme strives to keep this information up to date but cannot be held responsible for any inaccuracies. A parachute jump is always subject to weather conditions and the medical and physical eligibility of the participant.

Online forms

The Site provides forms for submitting booking requests or group quotes. By completing these forms, the user:

• Guarantees the accuracy and sincerity of the information provided
• Acknowledges having read the prerequisites and medical contraindications
• Agrees to be contacted by Berry Parachutisme for the purpose of processing the request
• Acknowledges that form submission does not constitute a definitive booking confirmation

A definitive booking confirmation occurs only after a response from Berry Parachutisme and payment of the corresponding price in accordance with the General Conditions of Sale.

Intellectual property

All elements of the Site (texts, images, videos, logos, graphics, structure, source code) are the exclusive property of SAS Flyingmany (Berry Parachutisme) or its partners, and are protected by French and international intellectual property law. Any reproduction, representation, modification, publication, transmission or distortion, in whole or in part, of these elements is prohibited without prior written authorization from Berry Parachutisme.

The Site may contain links to third-party sites (BMI calculator, document downloads, social media). Berry Parachutisme has no control over the content of these sites and accepts no responsibility for their availability, content or privacy practices. Liability

Berry Parachutisme makes every effort to ensure the availability and security of the Site. However, Berry Parachutisme cannot be held liable for:

These ToU are governed by French law. In the event of a dispute regarding the interpretation or execution of these terms, and failing amicable resolution, the parties shall submit to the exclusive jurisdiction of the Bourges Tribunal.
